General Terms of Service 

NOTE: BY USING OUR WEBSITE FOR BOOKING AND/OR SENDING US YOUR DEPOSIT (OR ANY SUBSEQUENT PAYMENT) TOWARD YOUR TOUR PRICE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE TERMS OF SERVICE BELOW.

Responsibility

Clients are responsible for selecting a tour suitable for their athletic ability, informing us of any medical or dietary restrictions, and obeying all safe biking rules. Chiang Mai Bicycle (CMB) reserves the right to decline or withhold service to any person who, for physical or other reasons, is deemed unfit for the tour. CMB is not responsible for cancellations or amendments due to acts of nature, civil unrest or inclement weather. Every care will be taken to respect your luggage at all times. However, CMB is not responsible for damage, loss or theft of your personal belongings.

Your Responsibilities

CMB is committed to making your tour as rewarding and fun as possible. But we require your help to do so. For example, we rely on you to provide us with necessary personal information (age, passport details, allergies, etc.) and travel preferences (type of bed, dietary needs, etc.) so we can arrange the right tour for you. We also ask that you respond to our questions in a timely manner so as not to delay the planning process.

Our Responsibilities

CMB recognizes the faith and trust you put in us. We will do our utmost to create and deliver the perfect tour for you. Our aim is to provide you with a reliable service. We will respond to your messages promptly and will keep you informed. If at any time you have questions or concerns, we ask that you let us know immediately so we can address them.

A deposit of 30% per person is required for multi-day tours at the time of booking. The deposit payment can be done via Paypal or via credit or debit card. For half-day or full-day tours, no deposit is required. (Final) payment has to be made in cash at the start of the tour to the guide or the representative of CMB in case of self-guided tours. 

The multi-day tour price is per person based on double occupancy and includes those items mentioned in the itinerary. Single room requests are subject to supplemental charges  and must be requested at the time of booking.

Insurance

CMB strongly recommends cancellation and accident insurance to prevent any losses in case of illness, accident or otherwise. It is the responsibility of the client to apply directly to the insurance company in their own country. Please purchase tour cancellation insurance in case an illness forces you to cancel or depart early from a tour. Our cancellation fees are not negotiable.

CMB does have local accident insurance for each participant of their tours. 

Cancellations 

In the event that you cancel your participation of the tour, CMB has the right to keep the following:

Cancellation of multi-day tours: for cancellations made more than 7 days before your booking date your deposit will be refunded after deduction of possible payment fees. If you cancel within a week of your booking date the deposit will not be refunded.

Cancellation of half-day and full-day tours: you can cancel 24 hours or more before the departure time of your tour without any charges. If you cancel less than 24 hours before the departure time of the tour we will charge 50% of the total price of your booking.

Cancellations must be submitted to CMB in writing. No refunds are made for unused portions of the tour once it has begun.

Cancellations by us

In very rare cases it may be necessary for CMB to cancel a tour. In the event of cancellation, a full refund of the deposit will be sent to the client and this constitutes full settlement. CMB is not responsible for other expenses incurred such as prepaid hotel reservations or non-refundable airline tickets. Scheduled guided tours with low enrollment may be subject to cancellation or changes. Registrants will receive a notice and full refund or option to move to another scheduled date.

Accommodations 

Our accommodations are in nice small hotels and guesthouses. We will do everything in our power to secure you lodgings in our first-choice hotels, but it may not always be possible especially if you are booking during a particularly busy season. In that case, we will secure you lodgings in comparable hotels. 

Rental Bicycles 

We will ask for your measurements to ensure that you get the most suitable bike possible, we strongly recommend that you book as early as possible.

You will be responsible for the bicycle once you take possession of it. Your responsibilities include any costs for damage or theft up to the full value of the bicycle.

Any customers who choose to bring their own bicycles are responsible for all mechanical issues, and for all transportation issues should they arise.

Limitation of Liability, Release and Indemnity

To be eligible to take a CMB tour, participants must accept the risks of travel, set out in these Terms of Service, and assume full responsibility for any loss, injury, death or damage to them, their family or their dependents or property arising in connection with their participation, or the participation of their family, in the tour. Participants must have their own insurance appropriate to their needs and the needs of their family or dependents in respect of such loss, injury, death or damage. The cost of all CMB tours is based on participants agreeing to these Terms of Service and in particular this Limitation of Liability,

Release and Indemnity

As CMB is acting solely as an agent of you with respect to all accommodations, meals and other arrangements, in consideration for participating in the tours, participants agree not to sue CMB, its employees, directors, successors, agents and assigns in respect of, and forever release them from, all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with the tour and the actions of any third-party service providers—including, without limitation, permanent disability and death; any emotional distress; any loss of services, financial support, aid, consortium or companionship; and any damage to or loss of property—in each case even if caused in whole or in part by the conduct, including the negligence, of CMB, except where such loss, injury or damage is caused by reckless or fraudulent conduct on the part of CMB or their employees, guides, shareholders, officers or directors, in which case the participant retains the right to sue only CMB in respect of that conduct. Participants further agree that they will indemnify and hold CMB harmless in respect of any claims arising in connection with the tour made by 

  1.  Third parties, which arise from the misconduct of the participants;
  2.  The participants family members, dependents or heirs;
  3.  Third parties, which the participant, their estate, their family members, dependents or heirs have sued, if damages are recovered from such third parties, to the extent the third party obtains any indemnification from CMB; except where the loss, injury, death or damage is caused by the reckless or fraudulent conduct on the part of CMB, or their employees, guides, shareholders, officers or directors. CMB reserves the right to decline to accept any participant whose health or actions in CMB’s sole judgment impede the operation of a tour or the welfare or enjoyment of fellow participants.

In addition and without limitation, CMB is not responsible for any injury, loss, or death, or damage to property in connection with the provision of any goods or services whether resulting from, without limitation, to acts of God or force majeure, weather, quarantines, illness, disease, acts of war, civil unrest, insurrection/revolt, animals, labor unrest, including strikes, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of means of transportation or travel delays, travel advisories or warnings.

In further consideration for participating in the tour, participants agree that CMB, or their designate, may use any photographic or film records of the tours for promotional and/or commercial purposes, without any remuneration to the participant. The participant agrees to assign all right, title and interest they may have in or to any media in which their name or likeness might be used to CMB.

Participants agree that CMB is the trustee of the respective rights of CMB under this Limitation of Liability, Release and Indemnity, which will apply to a participant’s tours with CMB, and any transfer of a reservation to another tour.

Governing Law 

These Terms of Service and any claim, controversy, dispute or cause of action (whether in contract or tort or otherwise) based upon, arising out of or relating to these Terms of Service and the tour hereby reserved shall be governed by, and construed in accordance with, the law of the Kingdom of Thailand.

Modifications

CMB reserves the right to modify the Terms of Service at any time without prior notice. Any changes will become effective immediately upon publication to the website, usage of the website and services post-change constituting  acceptance of the modified Terms of Service. If the modified Terms of Service are not acceptable to you, your only recourse is to cease using the website and services.

These Terms of Service and this Limitation of Liability, Release and Indemnity are binding upon all members of the participant’s family, dependents, estate, heirs, successors and legal personal representatives.
